1. Can a foreigner own property in Brazil?
Yes, with the exception of land within 150 Kilometres of the National Frontier and rural properties which have special conditions.
2. How long can I stay in Brazil?
You can stay 90 days on a tourist visa. This can be extended for another 90 days at the local police station. The authorities will let you stay a total of 182 days without needing to become a permanent resident.
3. How do I obtain a permanent visa?
A permanent visa can be obtained in the following ways:
(i) Invest US$50,000 or more in a business that is beneficial to the Brazilian economy.
(ii) A person over 50, who can prove a monthly income of US$2,000 or more.
(iii) Marriage to a Brazilian national. The marriage can take place in Brazil or your home country.
4. What are the costs in purchasing?
Purchasing costs are approximately 4% - 5% of the purchase price. Transfer tax (ITBI) can vary from municipality to municipality, but in general 2% - 3% notary and land registry fees a further 2%.
5. Can I get finance/mortgage?
Generally, mortgages are not available to foreign non-residents. Only foreigners with a permanent residence visa are likely to be eligible for a mortgage. However, many developers now offer attractive stage payments for off-plan properties.
6. Are there restrictions on repatriation of foreign capital?
Foreign capital may be repatriated to its country of origin at any time without authorisation, providing that the original capital introduced was registered with the Central Bank of Brazil.
Returns in excess of the registered amount will be considered capital gains for a foreign investor and thus subject to income tax.
